The 28-year-old – who cannot be named – is facing charges including persistent contravention of a family violence intervention order, wilfully damaging property and committing an indictable offence while on bail.
Police prosecutor Samantha Owen told Shepparton Magistrates’ Court the man, who appeared from custody, was arrested on September 24 after being found in breach of his intervention order restricting contact with his mother.
It was heard the man allegedly followed his mother home after she spotted him drinking in a park with two other males. She called police about 6pm fearing his behaviour would escalate after consuming alcohol.
It is not alleged the man committed any physical violence or made any threats.
Ms Owen said the man had also allegedly contravened the order on June 7, one of seven family violence incidents between the parties dating back to 2020.
The court heard the accused was also facing charges on a number of outstanding matters, including one from March 30 where he allegedly slapped his sister as she attempted to de-escalate a fight between the accused and their mother.
Police opposed bail for the “chronic alcoholic”, alleging he posed an unacceptable risk, particularly to his mother.
Defence counsel Ashlea Patterson submitted the man had issues with alcohol dependency, adding there was a “strong causal connection” between alcohol and the offending. She added the offending that sent the man back to jail – a contact-only intervention order breach – was “not a serious breach”, and was unlikely to see him spend more than 28 days in jail.
Magistrate David Faram fixed bail; he noted an ongoing risk to the victim if he attended at her property, but found it was unlikely he would spend “significant, or any” time in custody upon a conviction.
The man will return to court on November 5.
