Jail for weapon offence

The court heard police searched May’s car after they pulled him over in Parkside Dve, Shepparton on November 18 last year.

He told police he had a flick knife in his bag and it was seized.

May’s defence solicitor Anthony Coote said his client had an intellectual disability and ADHD.

At the time of going to court, May was in prison on remand for another matter.

Mr Coote said his client realised that prison was within range as his sentence for this matter.

In sentencing him to seven days in prison, magistrate Olivia Trumble said jail was the only option available to her.

“Had you not been in custody, I could have done something other than prison,” Ms Trumble said.

However, the magistrate noted that May had a long court record.

“You’re only 28 and your history looks like someone in their 50s,” Ms Trumble said.

The seven days in prison will be served separately to the time May is spending on remand for the other matter.
